Election Objections
A candidate, qualified political party, or thirty (30) voters of an election district may file a complaint with the Clerk of the Supreme Court. The complaint must present reasons that could cause a difference in the election results.
Deadline to File
All objections must be filed in writing with the Clerk of the Supreme Court by:
Primary Election: August 23, 2024, 4:30 pm
General Election: November 25, 2024, 4:30 pm
Primary Election
Upon filing the complaint, the Supreme Court will issue a summons requiring the defendants to respond no later than 4:30 pm on the fifth day after they are served.
The Supreme Court will issue its judgment fully stating all findings of fact and of law no later than 4:30 pm on the fourth day after the return on the summons. This will include a determination of which candidate was nominated to appear on the general election ballot or who was outright elected, depending on the office.
General Election
Upon filing the complaint, the Supreme Court will issue a summons requiring the defendants to respond no later than 4:30 pm on the tenth day after they are served.
Unlike the primary election, there is no statutory deadline for the Supreme Court to issue its judgment. When issued, the judgment will either decide which candidate or candidates were elected, or it may decide that the election is invalid. If the election is deemed invalid, a new election will be held within 120 days of the judgment.
